Texas Man Sues Macy’s and Sunglass Hut Parent Over Alleged Wrongful Arrest Linked to Faulty Facial Recognition

In a disturbing case of mistaken identity involving facial recognition technology, a Texas man, Harvey Murphy Jr., is pursuing a $10 million lawsuit against Macy’s and the parent company of Sunglass Hut, EssilorLuxottica. The lawsuit alleges that the companies relied on error-prone facial recognition tools, leading to Murphy’s wrongful arrest for an armed robbery he did not commit.

Murphy endured almost two weeks of incarceration before prosecutors verified his alibi, confirming he was not in the state of Texas during the robbery. Tragically, during his detention, Murphy was reportedly attacked and raped by three men, causing permanent injuries.

The lawsuit, filed in Harris County district court, claims that EssilorLuxottica used Macy’s facial recognition tools to identify Murphy in low-quality surveillance footage of the 2022 robbery at a Houston Sunglass Hut. The technology’s apparent error not only implicated Murphy in the specific incident but also linked him to earlier robberies affecting both companies.

Despite Murphy’s alibi of being in Sacramento, California, during the robbery, he was arrested based on the facial recognition match. The charges were dropped after his court-appointed attorney and Harris County prosecutors confirmed the alibi.

While the lawsuit focuses on the companies involved, questions remain about the relationship between EssilorLuxottica and Macy’s and the guidelines Macy’s follows for assessing confidence in facial recognition matches. Murphy’s legal team aims to uncover these details during the legal proceedings.

This case adds to a growing list of instances highlighting the risks and concerns associated with facial recognition technology, including mistaken identities, privacy issues, and potential algorithmic biases.
