Amber Heard Won’t Give Up, Wants New Trial Against Johnny Depp, Appeals $10 Million Payout

Lawyers for actress Amber Heard have filed a request for a new trial following her defeat in a defamation suit against her ex-husband Johnny Depp in June of this year. According to The New York Times, they claim that the previous trial was held in the wrong state and criticize the judge’s decision to ignore evidence favorable to Heard.

As reported by MARCA, the petition was filed by the actress’ representatives last week. Among the evidence rejected in the case that would help Heard prove that she was a victim of violence are documents signed by doctors attesting to abuse by Depp.

“The court improperly prevented the jury from considering several separate instances in which Heard reported Depp’s abuse to a medical professional,” the lawyers argue.

Amber was found guilty for the statements made in an article written in The Washington Post, in which she accused Depp of abuse. In the decision, the jury determined that the actress would have to compensate her ex-husband for US$15 million. But Amber will pay just over US$8 million.

Heard’s appeal also criticizes the court’s ruling that the trial could be held in Virginia, based on Depp’s lawyers’ argument that the Washington Post’s computer servers are there. Heard’s lawyers wanted the case to be moved to California, where the two actors lived.

The jury decision divided the damages into $10 million as compensatory measures for defaming Depp and another $5 million as punitive measures. The latter amount was reduced at the end of the verdict reading by Judge Penney Azcarate. Following the maximum ceiling for punitive damages in the state, the amount fell to $350,000.

In addition, Depp was also ordered to pay $2 million for defaming Amber Heard. Thus, the amount of $15 million was reduced to $8.35 million. Regarding Heard’s case against Depp, the actor was found guilty on one of the three counts. The “Pirates of the Caribbean” star will have to pay $2 million in moral damages to his ex-wife. Amber had asked for US$100 million in damages.
