Court Adjourns Speed Darlington’s N300M Suit Against Police to January 27

The Federal High Court in Abuja has postponed the hearing of a ₦300 million fundamental rights enforcement suit filed by singer Darlington Achakpo, widely known as Speed Darlington, against the Inspector-General of Police (IGP). The court adjourned the case on Monday to January 27, following a request by the police counsel, CSP Audu Garba, for additional time to review a further affidavit presented during the proceedings.

Justice Musa Liman granted the adjournment after Garba explained that he needed to study the new document, which was served in open court by Speed Darlington’s counsel, Abubakar Marshal. Marshal informed the court that the matter was originally scheduled for the hearing of the substantive application concerning his client’s claim of unlawful arrest and detention.

Marshal also noted that the police had filed their counter-affidavit on Friday, prompting his team to submit a further affidavit in response. However, Garba objected to proceeding immediately, citing the need to determine if the new affidavit introduced any fresh legal or factual issues.

Justice Liman directed the adjournment to allow for the necessary review and scheduled the adoption of applications for January 27.

The suit, marked FHC/ABJ/CS/1832/2024, was filed on behalf of Speed Darlington by human rights activist Deji Adeyanju. It alleges that the singer’s arrest and detention violated his constitutional rights. The application seeks four key orders, including an immediate and unconditional release or, alternatively, the presentation of Speed Darlington before the court to examine the circumstances of his detention.

Additionally, the lawsuit demands ₦300 million in damages for what the applicant describes as unlawful and continued detention since 2024. The Inspector-General of Police is named as the sole respondent in the case.
