Jamie Foxx Faces Lawsuit Over Alleged 2015 Rooftop Sexual Assault
Renowned actor, singer, and comedian Jamie Foxx is currently facing legal troubles as a woman has filed a lawsuit accusing him of sexual assault at a New York rooftop bar in 2015.
According to legal documents obtained by TMZ, the unnamed woman alleges that Foxx sexually assaulted her by groping her after she approached him for a photo at Catch NYC. The lawsuit encompasses charges of “sexual assault, abuse, assault, and battery,” seeking damages from Foxx.
The incident, as described in the lawsuit, allegedly occurred around 1 a.m. in August 2015. The documents state that Foxx, seemingly intoxicated, agreed to take a photo with the woman, assuring her with words like, “Sure, baby, anything for you.” Subsequently, Foxx is accused of leading the woman to a secluded area in the restaurant, where he allegedly touched her inappropriately without her consent, specifically her breasts and underneath her clothing. The incident reportedly came to an end when the woman’s friend intervened.
Foxx has yet to respond to the lawsuit or the specific claims made against him.
The legal action not only targets Foxx but also includes Catch NYC and its owner Mark Birnbaum. The woman alleges that the establishment and its owner failed in their duty of care. As of now, Mark Birnbaum has not commented on the lawsuit.
The woman claims to have suffered severe emotional distress, anxiety, humiliation, embarrassment, post-traumatic stress disorder, and other physical and emotional damages due to the alleged assault.
Interestingly, the lawsuit emerged just days before the expiration of the New York Adult Survivors Act on November 24. This act allows alleged victims of sex crimes to file lawsuits even after the statute of limitations has passed. Several other high-profile personalities, such as Diddy, Jimmy Iovine, L.A. Reid, Cuba Gooding Jr., Bill Cosby, Axl Rose, and Russell Brand, have faced lawsuits under this act.
It’s worth noting that this isn’t the first time Foxx has been accused of sexual misconduct. In 2018, he faced allegations of slapping a woman with his penis in Las Vegas in 2002. At the time, Foxx vehemently denied the accusation, and no charges or lawsuits were filed regarding the incident.
