Couple Suing Eataly Boston After Woman Slipped on Piece of Prosciutto and Broke Ankle, Lawsuit States

A New Hampshire couple has initiated legal proceedings against Eataly Boston following an incident in which a woman allegedly slipped and fell on a piece of prosciutto within the store, resulting in a broken ankle.

The incident occurred on October 7, 2022, when Alice Cohen was navigating her way to an area in Eataly that was offering food samples. The details of the incident were outlined in a lawsuit that was filed in the Suffolk County Superior Court in Massachusetts on Friday.

According to the lawsuit, as Cohen approached the designated area, she encountered an unfortunate accident. The court documents state, “she slipped and fell on a piece of prosciutto on the floor, injuring her left ankle resulting in a fracture.”

The repercussions of the incident extended beyond the immediate physical injury. Cohen’s medical expenses related to the injury totaled over $7,500. This encompassed hospital fees, doctor fees, and physical therapy.

The lawsuit asserts that Eataly failed to uphold the responsibility of ensuring a safe environment, devoid of unnecessary hazards, for its patrons. Beyond the physical consequences, the lawsuit further claims that Cohen suffered from “loss of enjoyment of life, and experiencing great pain and suffering.”

The lawsuit presents claims of negligence and loss of consortium. The couple is seeking $50,000 in damages and is also requesting a jury trial.

In an effort to obtain a comprehensive understanding of the situation, CNN has reached out to both Eataly Boston and the legal representative of the Cohens for their respective comments on the matter.
